These Terms of Service (“Terms”) govern the access to and use of the Eastcoast website, mobile site, applications, and related services (collectively referred to as the “Platform”). By accessing, browsing, or placing an order on the Platform, you (“User”, “Customer”, “You”) agree to be legally bound by these Terms.
If you do not agree to these Terms, you must immediately discontinue use of the Platform.
1. Eligibility & Acceptance
1.1 By using the Platform, you confirm that you are legally competent to enter into a binding contract under Indian law.
1.2 These Terms constitute a legally binding agreement between you and Eastcoast (“Company”, “We”, “Us”, “Our”).
2. Nature of Business & Disclaimer of Production
2.1 Eastcoast is not a self-production entity and does not operate farms or directly manufacture the food products sold on the Platform.
2.2 Products sold by Eastcoast are procured from third-party suppliers, vendors, and authorized sources.
2.3 Any inherent defects, natural variations, or supplier-originated issues in such products shall not be solely attributable to Eastcoast, except to the extent required under applicable law.
2.4 Eastcoast acts as a facilitator and distributor and complies with applicable FSSAI handling, storage, and transportation norms.
3. Account Registration
3.1 Users may be required to create an account using accurate, complete, and current information.
3.2 You are responsible for safeguarding your account credentials and all activities carried out under your account.
3.3 Eastcoast shall not be liable for losses arising from unauthorized access due to user negligence.
4. Order Placement & Acceptance
4.1 Orders may be placed only through Eastcoast’s official online Platform.
4.2 By placing an order, you agree to purchase selected products at the displayed price and accept all applicable policies.
4.3 Eastcoast reserves the right to accept, reject, modify, or cancel any order due to stock unavailability, pricing errors, suspected fraud, or operational limitations.
5. Online Payments Only – No Cash on Delivery
5.1 Cash on Delivery (COD) is not available under any circumstances.
5.2 All orders must be prepaid online using approved payment methods.
5.3 Orders placed offline, verbally, via third parties, or outside the Platform are not recognized, and Eastcoast bears no responsibility or liability for such transactions.
6. Payments, Failures & Legal Consequences
6.1 Non-payment, chargeback abuse, or deliberate payment avoidance may result in legal consequences, including recovery proceedings as permitted under Indian law.
6.2 Eastcoast shall not be responsible for:

Payment failures due to bank server issues

Technical errors or downtime of third-party payment gateways

Delays or deductions caused by banking institutions
6.3 Orders shall be considered confirmed only after successful payment receipt.
7. Product Availability & Substitution
7.1 Product availability depends on seasonality, procurement, and supplier conditions.
7.2 Eastcoast does not guarantee continuous availability of any item.
7.3 Substitutions or refunds may be offered strictly in accordance with company policies.
8. Delivery, Pickup & Shipping
8.1 Delivery timelines are estimates and may vary due to logistics, weather, regulatory checks, or third-party constraints.
8.2 All delivery, pickup, replacement, RTO, address-change, and third-party logistics conditions are governed by the Shipping & Delivery Policy, which forms an integral part of these Terms.
8.3 Orders once shipped cannot be cancelled.
9. Refunds & Replacements
9.1 Refunds and replacements are governed exclusively by the Refund & Return Policy.
9.2 Issues must be reported within 24 hours of delivery with valid photographic or video evidence.
9.3 Eastcoast reserves the right to approve or reject requests based on policy eligibility and verification.
10. User Responsibilities
10.1 Users must:

Be available during delivery or pickup

Store and handle perishable products responsibly post-delivery
10.2 Any misuse, repeated false claims, or policy abuse may result in service denial.
11. Prohibited Conduct
Users must not:

Engage in fraudulent transactions

Harass or abuse staff or delivery personnel

Misuse refund, replacement, or delivery processes

Manipulate pricing, logistics, or systems
Violations may lead to immediate account suspension or permanent restriction.
12. Brand Usage, Defamation & Social Media Policy
12.1 Use of the Eastcoast name, brand, logo, identity, images, or references on any social media platform, website, or public forum without prior intimation and consent is strictly prohibited.
12.2 Customers must raise concerns directly with Eastcoast through official channels before making any public statements.
12.3 Any content that is false, misleading, defamatory, or damaging to Eastcoast’s reputation shall result in legal action, including civil and criminal remedies under Indian law.
13. Intellectual Property
13.1 All content on the Platform, including trademarks, logos, text, images, and software, is the exclusive property of Eastcoast or its licensors.
13.2 Unauthorized use, reproduction, or distribution is strictly prohibited.
14. Privacy & Data Usage
14.1 Use of the Platform constitutes consent to data collection and processing as per the Privacy Policy.
14.2 Data may be used for order processing, communication, marketing, analytics, and service improvement.
15. Suspension & Termination
15.1 Eastcoast may suspend or terminate access without prior notice in cases of:

Fraud or misuse

Abuse toward staff or delivery personnel

Reputational harm or legal risk
16. Limitation of Liability
16.1 Eastcoast provides the Platform on an “as is” basis without warranties of uninterrupted service.
16.2 To the maximum extent permitted by law, Eastcoast shall not be liable for indirect, incidental, or consequential damages, including losses arising from third-party service providers or suppliers.
17. Indemnity
You agree to indemnify and hold harmless Eastcoast, its directors, employees, and partners from claims or losses arising from your breach of these Terms or misuse of the Platform.
18. Policy Updates & Modifications
18.1 Eastcoast reserves the right to modify these Terms at any time without prior notice.
18.2 Continued use of the Platform constitutes acceptance of updated Terms.
19. Governing Law & Jurisdiction
19.1 These Terms shall be governed by and construed in accordance with the laws of India, including the Consumer Protection Act, 2019, Consumer Protection (E-Commerce) Rules, 2020, and applicable FSSAI regulations.
19.2 All disputes shall be subject to the exclusive jurisdiction of the competent courts in India, limited to the city/state of Eastcoast’s registered operations, unless otherwise mandated by law.
